Please read these Terms of Service ("Terms") carefully before using BIZZBY. By accessing or using our service, you agree to be bound by these Terms.

1. Service Description

BIZZBY provides an AI-powered business operations platform ("Service") that offers AI agent teams to help users ("Founders") start, manage, and grow their businesses. Our Service includes access to AI-powered tools, automated workflows, website creation, business communications, analytics, and related features delivered through messaging platforms and web applications.

BIZZBY is a subscription-based service. Current plans range from $199 to $499 per month. Plan details, features, and pricing are available at bizzby.ai.

3. Your Account

To use BIZZBY, you must create an account and subscribe to a paid plan. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use BIZZBY. By creating an account, you represent that you are at least 18 years of age.

4. Subscription & Payments

Subscriptions are billed monthly. All fees are non-refundable except as required by applicable law. We may offer a free trial period; if you do not cancel before the trial ends, you will be charged for the first billing cycle.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. Upon cancellation, your AI agents will be deactivated and your workspace data will be retained for 30 days before deletion.

5. Your Content & Data

You retain ownership of all content you provide to BIZZBY, including business information, client data, images, text, and other materials ("Your Content").

By using BIZZBY, you grant us a limited license to use Your Content solely to provide and improve the Service. This includes:

• Processing Your Content through AI models to generate outputs for your business
• Storing Your Content in your dedicated workspace
• Using Your Content to execute tasks you request (website updates, emails, etc.)

You are responsible for ensuring you have the right to use any content you upload or provide to BIZZBY.

6. Aggregated & Anonymized Data

6.1 What We Collect

We may collect and aggregate the following categories of data in anonymized form:

• Business performance metrics: Revenue ranges, client counts, booking frequency, and average transaction sizes — aggregated by business type and market
• Growth channel effectiveness: Which marketing channels and strategies drive results for different business types
• Content performance: Which types of website content, email templates, and messaging approaches are most effective
• Pricing intelligence: How different pricing structures and packages perform across similar businesses
• Platform usage patterns: Which tools and features Founders use most, and how they use them
• Onboarding patterns: Common questions, setup sequences, and time-to-value metrics

6.2 How We Anonymize Data

Before any data is aggregated, we remove all personally identifiable information (PII), including:

• Founder names and contact information
• Business names and specific locations
• Client names, emails, and phone numbers
• Specific financial figures (converted to ranges or percentiles)
• Any content that could identify a specific business or individual

Aggregated data is only meaningful in groups. We never publish or share data that could be traced back to an individual Founder or their clients.

6.3 How We Use Aggregated Data

Anonymized, aggregated data is used to:

• Provide industry benchmarks: "Dog walking businesses in coastal markets typically see X% growth in their first 6 months"
• Improve AI recommendations: Better default suggestions for pricing, marketing channels, and business strategies based on what actually works
• Enhance onboarding: Streamline the setup process based on what similar businesses need
• Develop new features: Build tools and capabilities that address real needs across our Founder community
• Create educational content: Guides, benchmarks, and resources based on real-world data

6.4 Your Control

You may opt out of anonymized data collection at any time by contacting us at support@bizzby.ai. Opting out means:

• Your data will not be included in aggregated analyses
• You may not receive certain benchmark-based recommendations that rely on aggregated data
• All other Service features remain fully available

Opting out does not affect data already anonymized and aggregated prior to your opt-out request.

7. Acceptable Use

You agree not to use BIZZBY to:

• Engage in any illegal activity or promote illegal services
• Harass, abuse, or harm others
• Generate spam, misleading content, or fraudulent materials
• Attempt to reverse-engineer, decompile, or access the underlying AI systems
• Circumvent usage limits or access controls
• Store or process data in violation of applicable privacy laws
• Create fake reviews, testimonials, or endorsements
• Impersonate another person or business

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

BIZZBY and its underlying technology, branding, and content are owned by BIZZBY (entity TBD). You may not copy, modify, distribute, or create derivative works from our platform.

Content generated by BIZZBY's AI agents for your business (websites, copy, emails, etc.) is licensed to you for your business use. You may use this content freely for your business purposes.

9. Client Data & Your Responsibilities

If you use BIZZBY to manage client relationships, you are the data controller for your clients' personal data. You are responsible for:

• Obtaining appropriate consent from your clients for data collection and communication
• Complying with applicable privacy laws (including CCPA, GDPR, or other local regulations)
• Having your own privacy policy that discloses your use of AI-powered tools
• Responding to data access or deletion requests from your clients

BIZZBY acts as a data processor on your behalf and will process client data only as necessary to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by law, BIZZBY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the total fees you paid to BIZZBY in the 12 months preceding the claim.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. AI agents may occasionally be unavailable due to maintenance, updates, or technical issues. We will make reasonable efforts to notify you of planned downtime in advance.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in activity that could harm BIZZBY, other Founders, or third parties. In such cases, you may not be entitled to a refund.

Upon termination, you may request an export of Your Content within 30 days. After 30 days, your workspace and data will be permanently deleted.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of BIZZBY after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Diego County, California.
